These Terms of Service (“Terms”) govern your use of the Shorely Ibiza website, iOS app, and Android app (together, the “Services”) operated by SHORELY LTD (brand Shorely™, trading as Shorely Ibiza) (“Shorely”, “we”, “us”). By creating an account or using the Services, you agree to these Terms.

2. Scope of these terms

These Terms cover access to and use of the Services as a discovery and booking platform. Specific rules for placing a booking (including cancellation and refunds) are set out in our Booking Terms & Conditions, which you must accept in the app before payment.

Our Privacy Policy explains how we process personal data. Website cookies are described in our Cookie Policy.

3. Platform role

Shorely is a discovery and booking platform. We act as a commercial agent facilitating bookings between users and independent Spanish venue and service partners via our mobile apps. We are not the provider of beach services, food, drink, activities, accommodation, or other experiences listed on the platform. The contract for the booked service is between you and the venue.

6. Website (no bookings)

The public website at shorelyibiza.app is for marketing, information, and legal notices. Bookings and payments are not completed on the website; they are completed only in the Shorely mobile apps.

7. User content

Reviews and other content you submit are your own opinions. You grant Shorely a non-exclusive licence to publish that content on the Services for marketing and listing purposes. We may remove content that is defamatory, offensive, unlawful, or false.

8. Intellectual property

Platform design, software, Shorely-produced text and photography, and related materials are owned by Shorely or its licensors. You may not scrape, copy, or reproduce them except as allowed by law or with our written permission. Partner venues remain responsible for their own images and brand assets, which they licence to us for listing purposes.

9. Limitation of liability

Shorely is not liable for the quality of services provided by partner venues; force majeure events; or indirect or consequential losses. Where liability cannot be excluded, Shorely’s aggregate liability to any user is capped at the value of the most recent booking made by that user through the Services. Nothing in these Terms excludes statutory rights under applicable UK, Spanish, or EU consumer law.

10. Governing law and disputes

These Terms are governed by the laws of England and Wales, without prejudice to mandatory consumer protections that apply to you. For disputes about the underlying venue service performed in Spain, Spanish law and the courts of Ibiza (Juzgados de Ibiza) may apply as between you and the venue. EU consumers may also have rights under Regulation (EU) 1215/2012.

Complaints and dispute resolution

Please contact us first at support@shorelyibiza.app. We aim to acknowledge complaints within 5 business days and to resolve them within 30 days.

If we cannot resolve your complaint, consumers resident in Spain may refer the matter to the Sistema Arbitral de Consumo through the consumer office (Oficina Municipal de Información al Consumidor) of their municipality or the Dirección General de Consumo of the Govern de les Illes Balears. Consumers elsewhere in the EU may contact their national consumer authority or an approved alternative dispute resolution body, and may use the European Consumer Centre network at eccnet.eu.

The European Commission’s Online Dispute Resolution platform ceased operating on 20 July 2025 and is no longer available.
